Le système interaméricain de protection des droits de l'Homme, qui repose essentiellement sur la Convention américaine des droits de l'Homme adoptée en 1969, reste méconnu, en particulier de la doctrine francophone. Pourtant, la Cour interaméricaine des droits de l'Homme a rendu une jurisprudence contentieuse et consultative, certes encore qualitativement modeste, mais tout à fait stimulante, et, à maints égards, remarquable et inédite. Cette étude, qualifiée par Antônio Augusto Cançado Trindade, juge et ancien président de la Cour interaméricaine, d'«ouvrage de référence incontournable en la matière», offre une analyse systématique des mécanismes de protection et de l'étendue des droits et libertés de la Convention américaine.

The book La convention américaine des droits de l’homme – mécanismes de protection et étendue des droits et libertés is a well-written and painstakingly well-researched book, which will surely prove to be of great value to both practitioners and academics, and deserves a wide audience. As a first empirical French-language study of this kind, it allows interested readers to use this book as a springboard for their own research. This is an inescapable reference for anybody interested by the inter-American system for human rights.
The inter-American system of protection of human rights, which mainly relies on the American Convention on human rights, remains unknown in Europe, especially in the francophone jurisprudence. Therefore, Ludovic Hennebel took up the challenge to explore the protection mechanisms and the scope of the rights and liberties of the American convention. Hennebel’s detailed use of the stimulating and qualitatively remarkable inter-American Court of Human Rights’ case-law, which is still quantitatively modest and unedited – and thus difficult to access – is impressive. This study is undoubtedly a breakthrough and has been qualified in the foreword by Antonio A. Cançado Trindade, judge and former president of the inter-American Court as “an ineluctable work of reference in the field”.
This three-tier book has a clear and appealing structure. The opening chapter unravels the foundations of the inter-American human rights law by examining the Covenant of San José in the context in which it saw daylight and in which it developed. Then, before analyzing the extent of the rights and liberties, a procedural chapter scrutinizes the different phases of the individual complaints procedure of the American Convention: admissibility; provisional or interim protective measures; reparation; execution and supervision. The inter-American Court does not only exercise contentious jurisdiction, but it can also deliver advisory opinions, which allow the Court to interpret the American Convention, as well as the relevant international human rights law. Since the advisory jurisdiction is far from accessory – to the contrary it even takes a central place in the inter-American system – a thorough examination of the procedural rules that regulate its functioning is indispensable. Finally, the last, substantial chapter canvasses the obligations and the rights and liberties enshrined in the American Convention. Therefore, it analyses systematically the contentious and advisory case-law of the inter-American Court, while taking into consideration certain contentious decisions of the inter-American Commission. The proceeds of this examination are presented one theme at the time.
