Douch, chef de la prison de Phnom Penh sous le régime cambodgien des Khmers rouges, où quelque 15.000 personnes ont été torturées avant d'être exécutées, a été condamné le 3 février en appel à la perpétuité dans le premier verdict définitif du tribunal parrainé par l'ONU.

The African human rights system has undergone some remarkable developments since the adoption of the African Charter on Human and Peoples’ Rights, the cornerstone of the African human rights system, in June 1981. The year 2011 marked the 30th anniversary of the adoption of the African Charter. It also marked 25 years since the African Charter entered into force on 21 October 1986.

The European Court of Justice recently issued an important decision in two joined cases dealing with the interpretation and application of EU law and regulations relating to asylum applicants : Joined Cases C-411/10 and C-493/10, N. S. v. Secretary of State for the Home & M. E. et al. v. Refugee Applications Commissioner et al. (December 21, 2011).
The Court concluded that asylum seekers may not be transferred to a Member State where substantial grounds exist that the asylum seeker would face a real risk of being subjected to inhuman or degrading treatment. The Court also ruled that EU law prohibits the conclusive presumption that Member States in fact observe the fundamental rights of the European Union.

Le Haut commissariat des Nations Unies pour les réfugiés (HCR) a salué le 29 décembre 2011 la décision de la Géorgie d'adhérer à la Convention de 1954 relative au statut des apatrides. Les instruments d'adhésion ont été déposés à l'ONU à New York le 23 décembre 2011 et la Convention entrera en vigueur en Géorgie le 22 mars 2012.

With the growth of the Treaty Body System, harmonization and coordination of working methods between the treaty bodies became a pressing issue. Commentators spoke of a crisis of the system - victim of its own success. In 2002 the UN Secretary-General (‘An agenda for future’) considered that the development of the system, among others, increased pressure on resources of both States and the secretariat and had implication on the ability of the States to continue to meet their reporting obligations, while the secretariat struggled to continue to provide quality service to all treaty bodies.

Dans son premier rapport sur la situation des droits humains des lesbiennes, gays, bisexuels et transgenres, le Haut commissariat des Nations Unies aux droits de l'homme (HCDH) appelle les gouvernements du monde entier à abroger toutes les lois discriminant les personnes à cause de leur orientation sexuelle et leur identité de genre ainsi qu'à garantir le respect de leurs droits fondamentaux.

Après avoir mené des entretiens avec 223 victimes et témoins sur les allégations de violations des droits de l'Homme, la Commission d'enquête des Nations Unies sur la Syrie a estimé dans un rapport publié le 28 novembre que des crimes contre l'humanité ont été commis par « les militaires et les forces de sécurité syriennes depuis le début des manifestations au mois de mars 2011 ».

La Convention européenne des droits de l’Homme fait incontestablement partie des grandes réussites juridiques européennes. En 60 ans, elle aura réussi à faire oublier les conditions éminemment (géo)politiques de sa naissance, à étendre son emprise de 15 à 47 pays européens, et à développer des concepts et des techniques jurisprudentiels propres au droit européen des droits de l’Homme. Surtout, elle aura joué un rôle central dans l’affirmation de l’existence d’un droit autonome des droits de l’Homme. Une telle réussite n’est pas imputable à la seule jurisprudence européenne mais elle a aussi partie liée avec un projet savant.
